Who We Are

Southern Hospitality Concessions, LLC, its affiliates, subsidiaries and related companies (collectively, "SOHO") is a food and beverage concessions and event service provider. References to SOHO include (without limitation):

  • SOHO operated events ("Events");

  • Websites controlled by SOHO; and

  • Other current and future SOHO affiliates and subsidiaries.

Information We Collect

Contact and billing information. When you create an account, request information or services, we will collect your contact and billing information, such as your name, street address, zip code, email, phone number and credit card information.

Registration, Social Media, and Other Information. To enable you to participate in our offerings and fulfill your requests for information regarding our services, career opportunities, and offerings, we may collect certain personally identifiable information, including contact information such as name, address, telephone number, and e-mail address. We also may collect information about your interest in and use of our services and offerings. If you connect to our Site or sign up for information or services using your social media credentials (e.g., Facebook), you authorize us to collect your basic demographic information, such as your name, e-mail address, age, and gender.

If you post information or content, such as by posting photos, commenting on a blog, or participating in online forums or communities, or when you interact with our Site through social media sites, plug-ins or other applications, depending on your privacy settings, this information may become public on the Internet. Therefore, we cannot prevent further use of this information. You can control what data you share through privacy settings available on some social media sites. Demographic Information. We might collect information like your age range, race, or gender, or information about events you like or services you are interested in. We might collect this as part of a survey, for example.

Accessibility Information. We may collect details of your health requirements if you have accessibility requirements when attending Events.

Security Information. We may collect personal information on incidents and accidents that occur at the Events that may include the use of closed-circuit television video (CCTV), video taken from security cameras, photographs and pertinent personal information regarding accidents/injuries that may have occurred at Events.

Information Used for Health/Safety Purposes. We may collect information from attendees at Events for compliance purposes related to health and safety information to the extent required under applicable law. This information may include names, contact and venue information.

Technical and Usage Information. We also collect certain information when you use our Site such as the type of browser you are using (e.g., Chrome, Safari, Firefox), the type of operating system you are using (e.g., Windows, Mac OS, iOS, and Android), the domain name of your Internet service provider or mobile carrier, IP address, and certain usage information.

Information from Mobile Devices. If you access our Site on your mobile telephone or other mobile device, we also may collect your unique device identifier and mobile device IP address (e.g. MAC address), as well as information about your device's operating system, mobile carrier, and mobile Internet browsers, geo location information, and other information described in this Privacy Policy.

Information from Other Sources. We may, on occasion, combine information we receive online with outside records and use such information in accordance with this Privacy Policy, such as to enhance our ability to market to you offerings and services that may be of interest to you.

Offline Services

If you attend one of our Events, we also may collect certain information. We may process identity data (name, address, transaction data, payment data, preference data, general location data, and contact data when you attend our Events). We may use this information for purposes, including:

  • verifying your identity for authentication and security purposes;

  • helping us to ensure our customers are genuine and to prevent fraud; and

  • to help us to return lost property to its rightful owner.

How We Use Information and Legal Basis for Processing

Registration and Account Information. We use information you provide to fulfill your requests for services and offerings (e.g., subscribe to our newsletters, etc.), respond to your questions, improve Site content, and to offer you other products, programs or services that we believe may be of interest to you.

We also may use personally identifiable information to contact you regarding your use of our offerings, services, changes to this Privacy Policy, Terms of Service, or other policies or terms that affect you and use of our Site or our offerings. In addition, we may use such information to improve the content and navigation of our Site, or for other internal purposes.

For example, we use information collected on mobile devices to enable you to do things like (i) watch video clips, (ii) get news and updates, (iii) locate and access personalized information or functionality based on your location (e.g., find events near you, tag photographs, or check in to a certain venue), and (iv) follow blogs. We may also use this information to offer you services, programs and events we believe may be of interest to you and otherwise tailor your experience.

Legal Bases. We rely on a number of legal bases to use your information in these ways, including:

To fulfill a contract, or take steps linked to a contract. This includes:

  • Account creation and processing any offerings or services that you have requested;

  • Verifying your identity;

  • Processing payments;

  • Sending you necessary communications (for example, related to services, payments, or Events); and

  • Providing customer service or support.

As required to conduct our business and pursue our legitimate interests, in particular:

  • Providing you with offerings or services you have requested;

  • Analyzing your use and measuring effectiveness of our Site to better understand how they are being used so we can improve them and engage and retain users;

  • Sending you information about services, special offers and similar information, and sharing your information with third parties for their own marketing purposes;

  • Analyzing your use of our Site, your content, and your interaction with our communications, to tailor and customize the website and marketing communications;

  • Diagnosing problems with our Site;

  • Detecting, preventing, or otherwise addressing fraud, security or technical issues, as well as protecting against harm to the rights, property or safety of SOHO, our users, or the public;

  • Conducting surveys and market research about our customers, their interests, the effectiveness of our marketing campaigns, and customer satisfaction (unless we need consent to undertake such surveys, in which case we will only do this with your permission);

  • If we merge with or are acquired by another company, sell a website or business unit, or if all or a substantial portion of our assets are acquired by another company, your information will likely be disclosed to our advisers and any other prospective purchaser's advisers and will be one of the assets that is transferred to the new owner; and

  • In connection with legal claims, compliance, regulatory and investigative purposes as necessary (including disclosure of information in connection with government agency requests, legal process or litigation).

Where we process your information based on legitimate interests, you can object to this processing in certain circumstances. In these cases, we will cease processing information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons.

Where required, when you give SOHO your consent or otherwise consistent with your choices:

  • Sending you information about our Site, services, Events, special offers and similar information, and sharing your information with third parties for their own marketing purposes;

  • Placing cookies and using similar technologies on our Site and in email communications; and

  • For targeted online and offline marketing including through tools like Facebook Custom Audience.

What Information We Share

Our Affiliates and within the SOHO Family of Companies. We may disclose personally identifiable information to our corporate subsidiaries or entities affiliated with SOHO. Any personally identifiable information provided to SOHO's entities affiliated with SOHO will be treated by those subsidiaries and affiliated entities in accordance with similar principles in this Privacy Policy.

Agents and Contractors. We may use the services of agents and contractors to assist us in providing our offerings and services.

Brand Partners. We may, from time to time, share personally identifiable information with unrelated third parties (e.g., other marketers/brand partners) to enable them to provide users with opportunities to learn of products, offerings or events in which they may be interested. Please see the "Your Choices" section below for more information on how you can express your preferences regarding our sharing of information.

Legal, Law Enforcement, Fraud Prevention, Safety and Security Purposes. We may disclose personally identifiable information in response to legal process (e.g., a court order or a subpoena) or comply with legal requirements. We also may disclose such information in response to a law enforcement agency's request or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, to detect, prevent or otherwise address fraud, security or technical issues, situations involving potential threats to the property or safety of any person, violations of our Terms of Service, or as otherwise required or permitted by law.

Change of Control. We may transfer information about you in the event of a business transaction, such as if we or one of our business units or our relevant assets are acquired by, sold to, or merged with another company.

Aggregate Data. We may disclose anonymous, aggregated user statistics to third parties for a variety of purposes. For example, we may disclose how many individuals visited certain areas of our Site, how many men or women sign up to a particular service, or other demographic data about users of our offerings.

Your Privacy Rights

Your "Do Not Sell or Share" Rights Under the CCPA. Under the California Consumer Privacy Act (CCPA), California residents have the right to opt out of the sale or sharing of their personal information, as defined by the CCPA. California residents may exercise this right to opt out by submitting a "Do Not Sell or Share" My Information request to us via one of the contact methods in the Contacts Section at the bottom of this Privacy Policy.

To verify your identity, we may collect information such as your full name and email address. This information will be compared to our existing records to verify the identity of the individual submitting the request. We may also require you to confirm your request via an automated email message before responding to your privacy rights request. Depending on the sensitivity of the information requested and the type of request, we may require additional information to verify your identity before responding. We will respond to your request within 45 days if possible and required under the law. Cookies, Beacons and Do Not Track

Cookies

When you visit our Site, we, third party service providers, and partners may use "cookies" or similar technologies, such as pixels and SDKs to:

  • provide, develop, maintain, personalize, protect, and improve our services and content (e.g., improve our Site);

  • perform analytics (see how different parts of our Site are working and see what visitors are interested in);

  • protect against, identify, and prevent fraud and other unlawful activity;

Web Beacons

We may also use "Web beacons" or similar technologies that monitor your use of our Site. Web beacons (or Web bugs) are small strings of code that enable delivery of a graphic image on a Web page for the purpose of transferring data, such as the IP (Internet Protocol) address of the computer that downloaded the page on which the Web beacon appears, the URL (Uniform Resource Locator) of the page on which the Web beacon appears, the time the page containing the Web beacon was viewed, the types of browser that fetched the Web beacon and the identification number of any cookie on the computer previously placed by that server.

When corresponding with you via HTML capable email, Web beacons and similar technologies let us know whether you received and opened our email.

Do Not Track

We do not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.

From time to time, we may offer content (e.g., promotions) that is sponsored by or co-branded with an identified third party (e.g., brand partners). In these instances, the third party may obtain information that you voluntarily submit to participate in a Site activity. We have no control over the third party's use of this information.

Our Site also may contain links to other sites whose information practices may be different than ours. You should consult the other sites' privacy notices as we have no control over information that is submitted to, or collected by, these third parties.

Data Security

We have security measures in place to protect against the loss, misuse or alteration of information that we have collected from you at our Site.

Data Retention

We will retain your information only for as long as is necessary for the purposes set out in this Privacy Policy, for as long as your account is active, or as needed to provide our Site and services to you. If you no longer want SOHO to use your information to provide our services to you, you can request for us to close your account by contacting us via one of the contact methods in the Contacts Section at the bottom of this Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this Privacy Policy.

Data Transfers

The main location where we process your personally identifiable information is the United States but we also transfer personally identifiable information to all other countries in the world where our Site and other products or services are available. The data protection and privacy regulations in the US and other countries may not offer the same level of protection as in other parts of the world, such as the European Union. If you use or visit our Site from outside the United States, you consent to the collection and/or processing in the United States of information we collect from you.

Updates

From time to time, we may update this Privacy Policy. We will notify you of material changes to our Privacy Policy by placing a notice on our Site or contacting you with the email address we have in our records. You have the right to exercise these rights free of charge or penalty, but we may limit the number of requests you make or charge reasonable fees as legally permitted.

You may designate an authorized agent to exercise some of your rights; however, in order to help protect the security of your personal information, the authorized agent must follow the same authentication procedures that are required if you exercise your rights without using an agent. SOHO will verify requests made through authorized agents to help ensure the safety of your account and to comply with our policies and procedures.
